Kusum Pharm landmark victory before the Appeals Chamber of the High Anti-Corruption Court
The Aequo team has obtained a precedent-setting victory for Kusum Pharm, one of Ukraine’s leading pharmaceutical companies, in a complex legal dispute with the Ministry of Justice of Ukraine before the Appeals Chamber of the High Anti-Corruption Court.
The Ministry of Justice sought 50% of the shares in the company to be transferred to the state, alleging that one of the sanctioned individuals might still be able to control the company’s assets.
The Appeals Chamber of the High Anti-Corruption Court overturned the first-instance decision and upheld Aequo’s arguments, issuing a landmark ruling in favour of a private investor in a sanctions-related case.
“In today’s environment of challenges and transformation, it is crucial to maintain a balance between the interests of the state and the rule of law. We firmly believe that only a transparent, fair, and adversarial judicial process can strengthen trust in the legal system and protect bona fide business actors who contribute to Ukraine’s economic resilience even under martial law,” said Oleksiy Filatov, Senior Partner at Aequo.
This victory was the result of effective collaboration between the Aequo and Kusum Pharm’s team.
The project team included Senior Partner Oleksiy Filatov, Senior Associate Iryna Halych, and Associate Olha Hutsova.
