Aequo Successfully Defends Interests of Private Investors in Ukraine in Land Disputes

The Aequo’s Dispute Resolution Team has successfully defended interests of a group of private investors in Ukraine in a number of land disputes with the Kyiv Region Prosecutor’s (Attorney General) Office.

The subject of the dispute was challenge of the decision of the region and district state administrations by the Kyiv Region Prosecutor’s Office regarding seizure and transfer of land plots, invalidation of certificates of title under the land transfer acts, reclamation of land plots. The dispute was worth over USD 6 million.

According to the Court decision, the claims of the Kyiv Region Prosecutor’s Office were dismissed due to their inconsistency. Besides, the court pointed out the running of the statute of limitations by the Prosecutor and referred to the latest legal opinion of the Supreme Court of Ukraine regarding the period of limitations in disputes on invalidation of certificates of title under the land transfer acts in one of the cases.

The Aequo’s counsel Pavlo Byelousov as well as senior associates Myroslava Savchuk and Yevgen Levitskyi, and associate Anna Konovalova represented the clients in court proceedings.
