Aequo secures a victory for its client in an unfair competition dispute

Aequo successfully acted for Darnitsa, a leading Ukrainian pharmaceutical company, in a dispute initiated by Zdorovia Pharmaceutical Company LLC seeking invalidation of the resolution of the Antimonopoly Committee of Ukraine on violation of the laws on protection against unfair competition.

Zdorovia Pharmaceutical Company appealed the resolution of the Antimonopoly Committee before the court, whereby Zdorovia was recognised as having committed an act of unfair competition in the form of unauthorised use of packaging of "Citramon-Zdorovia" pharmaceutical product similar to the packaging design of "Citramon-Darnitsa" pharmaceutical product. For the said violation, the Committee imposed a penalty on Zdorovia Pharmaceutical Company in the amount of UAH 10 million.

The Kyiv City Commercial Court resolved the dispute in favour of Darnitsa by having upheld the relevant resolution of the Antimonopoly Committee of Ukraine.
