Naftogaz secured a leave to enforce the $1.4 billion award against Gazprom in Kazakhstan

Naftogaz secured a leave to enforce the $1.4 billion award against Gazprom in Kazakhstan

The Astana International Financial Centre Court (AIFC Court) has rendered a decision recognizing and granting leave to enforce an arbitral award in a case against Gazprom where Aequo, together with Wikborg Rein, Nybron and Gabriel Arbitration, represented Naftogaz of Ukraine.

On 16 June 2025 an arbitral tribunal acting under the ICC Rules rendered an award in favour of Naftogaz of Ukraine in the amount exceeding USD 1.4 billion due to Gazprom's failure to comply with a 2019 contract for 2020–2024 gas transit through Ukraine.

In its judgment, the AIFC Court confirmed its jurisdiction, recognized and allowed enforcement of the said arbitral award within the territory of the Republic of Kazakhstan.

This decision is unprecedented and became the first decision of a foreign court recognizing and enforcing the arbitral award in this case against Gazprom in the territory of a foreign state.
