Aequo successfully represented BlaBlaCar in a landmark decision by the Antimonopoly Committee of Ukraine (AMCU) concerning digital platforms
The AMCU adopted a decision confirming that BlaBlaCar (ITRAVELS LLC) had implemented the Committee’s 2024 recommendations regarding approaches to monetizing carpooling services.
This case set a precedent in the AMCU’s practice concerning an international digital platform and marked an important milestone in shaping Ukraine’s competition policy in digital markets.
Aequo’s team represented BlaBlaCar at all stages of interaction with the AMCU, developing a comprehensive legal and economic argument grounded in EU practice and OECD principles, while also reflecting the specifics of digital ecosystems and shared mobility models.
To confirm compliance with the recommendations, BlaBlaCar submitted to the AMCU an economically substantiated analysis of the carpooling monetization model in Central and Eastern Europe, demonstrating the balance of its service fee and alignment with international practices for two-sided platforms.“This case became an example of effective dialogue between the AMCU and international business, demonstrating the regulator’s openness to balanced approaches in the digital economy,” said Aequo Partner Mariya Nizhnik.
The project team was led by Partner Mariya Nizhnik and included Counsel Oleksandr Diakulych and Associate Kyrylo Filevskyi.
