Aequo lawyers successfully protected interests ofa German client in the safeguard investigation against imports to Ukraine of syringes regardless of the country of origin and export.
On 7 December 2019 Ukrainian Interdepartmental Commission on International Trade (Commission) initiated the safeguard investigation againstimports to Ukraine of syringes regardless of the country of origin and export. The decision on initiation of the investigation was based on the claim submitted by domestic producer - PJSC "Enterprise for manufacturing of medical products from polymeric materials "Hemoplast" (Hemoplast).
The safeguard investigation was conducted by the Ministry of Economic Development and Trade of Ukraine (Ministry). In the course of the investigation Aequo represented interests of leading German producer of medical devices (Client).
Due to filing objections to the national producer’s application for initiation of the Investigation and post-hearing submission, drafting response to the Ministry`s questionnaire, in September 2020, the Ministry made a conclusion to terminate the Investigation and the Commission has taken the final decision not to apply safeguard measures. Thus, Ukrainian market of syringes was not restricted and remains open for fair competition.
